OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Hydrologic Balance <br />PROBLEM/POSSIBLE VIOLATION: Problem: Property owner to the north of the permit (A&W Water Service Inc.) <br />has reported impacts (inability to pump at previous rate) to their production well located approximately 650 <br />north of operator's unlined Stage 6 mining cell. This complaint is substantiated by monitoring well data from <br />the immediate area showing significant declines in static groundwater levels throughout 2017 and early 2018. <br />This a problem related to 34-32.5-116(4)(h) of the Colorado Revised Statutes and 3.1.6(1)(a) of the Construction <br />Materials Rules and Regulations which require that disturbances to the prevailing hydrologic balance be <br />minimized. <br />CORRECTIVE ACTIONS: The operator has recently implemented corrective action as approved in TR05 (see <br />attached photos). This action has already resulted in a measured increase in groundwater levels near the A&W <br />well of approximately two feet. The operator stated that they intend to increase the groundwater level in the <br />recharge area as soon as possible to further minimize impact to the hydrologic balance. <br />DRMS will require that a stability analysis be performed on the existing/proposed compacted earth berm <br />currently dividing Stage 6 as soon as possible, and the final design be submitted to DBMS as a technical revision <br />prior to increasing the berm elevation, or raising the water level in the existing recharge pond.
