Therefore, exposure of ground <br />water must not occur during or after mining operations. <br />® Water is proposed to be used at the site for dust control purposes. The applicant will need to <br />document that the water was obtained from a legal source, or the water was diverted in priority under <br />a water right decreed for such mining/ industrial use. <br />COMMENTS: The borrow area for the project is currently permitted under M-2017-053 and the application is a <br />continuation of this property. The subject application is for a surface mining operation on 11.5 acres located <br />northeast of Greeley, Colorado. The primary commodity to be mined at the site is fill dirt for a construction <br />project along Weld County Road 47. Upon reclamation, the site is proposed to serve as a recharge pond. <br />Ground water is not anticipated to be encountered during this mining operation, but if encountered, mining <br />will be moved away from the water. The only proposed use of water at the site is for dust control purposes. <br />The source of this water will be the same as the project's source along Weld County Road 47. <br />If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must be <br />released to the stream system within 72 hours; otherwise the operator wit( need to make replacements for <br />evaporation. <br />The map included in Exhibit E(2) indicates that the proposed recharge pond will be connected to an existing <br />recharge pond on-site. This existing pond was decreed in Division 1 Water Court Case No. 2006CW114 <br />("decree") and is referred to as the Swanson Recharge Pond. Pursuant to paragraph 16.A of the decree, a staff <br />gauge shad be installed in the proposed pond and a stage -area -capacity table shall be developed. The survey <br />and methodology for this table shall be provided to the Division Engineer and all objectors in the case.
