The Division finds that the activities proposed by the applicant would not affect the continued
existence of endangered or threatened species or result in the destruction or adverse
modification of their critical habitats (2.07.6(2)(n)).
16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of
this time, October 29, 2013, the operator is current in the payment of reclamation fees
required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)).
Section B - Rule 4
I. Roads
The NHM permit area is transected by three separate county roads: Montrose County 2700
Road runs north -south through the middle of the permit area, BB Road is oriented east -west
and 5th Street is parallel to BB Road `/z mile south. These roads were disturbed by mining
operations and have since been reconstructed and opened for public use. ERMR
reconstructed the roads to the specifications outlined by Montrose County. Montrose County
has assumed responsibility for the roads which were released from reclamation liability in
SL -17 and removed from the permit in TR -73. Details addressing the various county roads
impacted by operations are provided in Attachment 2.05.3(3)-8 and on Maps 2.05.3(3)-8, -9,
-10 and -13.
Haul Roads
The Lincoln Street Haul Road is the only remaining certified haul road in the permit. It
provides access from Lincoln St. to the facilities area in the south eastern part of the permit.
The plan and profile are provided on Map 2.05.3(3)-8. No alternative criteria or
specifications were used for the Lincoln Street Haul Road and details of its construction can
be found in section 2.05.3(3)-8.
No access or light use roads have been permitted.
II. Support Facilities
Support facilities are located at the southeastern portion of the permit area. Details of the
various facilities are addressed in Section 2.05.3(3), Subsection 11 of the permit application
package. Facilities include office and storage buildings, equipment shop, and petroleum
storage. Storage of petroleum products complies with the mine's Spill Prevention, Control
and Countermeasure (SPCC) plan. There are no coal preparation plants, conveyors, or
permitted rail spurs. Coal was loaded into contract haul trucks within the disturbed area and
transported directly to the power plant. A coal storage area was approved in TR -81 to store
coal west of the facilities area for future use at the Nucla Power Plant.
III. Hydrologic Balance
21
