In order to complete the Application, it is necessary to
provide "Structure Agreements" with the owners of all structures located within 200 feet of the
permit area, as required by Rule 6 of the Mineral Rules and Regulations ("Rules"). The
undersigned is personally familiar with the permit area and all near-by structures. Please
consider this letter as the statement of Caerus that all structures, as defined in the Rules, located
within 200 feet of the permit area are operated by Caerus. Accordingly, it is Caerus'
understanding that Structure Agreements, as required by Rule 6, are unnecessary for purposes of
the Application and can be waived.
