As the design of the bulkhead is entering its final draft for review <br />DBMS has carefully looked at its jurisdictional authority. Based on the accepted Consent Decree and <br />Remedial Action Plan the underground bulkhead is part of the continuing efforts to address water quality <br />and quantities. This is clearly part of the Decree and Plan. <br />The Decree and Plan jurisdiction lies with the Colorado Department of Public Health and Environment <br />(CDPHE). CDPHE has an established relationship for review of such projects with the DRMS Inactive <br />Mines Program (IMP) which ,viii need to be utilized for the actual bulkhead design review and <br />construction. DRMS Mineral Program authority for the active permit is limited to surface disturbance <br />activities and reclamation of those areas. Based on current plan discussions a Technical Revision (TR) to <br />the permit will be necessary to address the upgrades to the portal entrance and any surface water <br />conveyance modification in association with the project.
