PERMIT #: M-1978-102 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: March 28, 2018 <br />the State Engineer, show evidence that the operator is taking measures to bring the site into compliance with <br />the SEO, or backfill the pit to at least two feet above the groundwater surface by the corrective actio_ n date <br />specified. <br />CORRECTIVE ACTION DUE DATE: 6/01/18 <br />INSPECTION TOPIC: Signs & Markers <br />PROBLEM/POSSIBLE VIOLATION: Problem: The affected area boundary markers are incorrectly placed. This is a <br />problem for failure to maintain boundary markers around the affected area as required by Section 3.1.12(2) of <br />the rule. The boundary markers as placed define an area of 9.76 acres, while the permit only allows 9.4 acres at <br />this time. (see attached map) <br />CORRECTIVE ACTIONS: The operator shall conduct a survey and replace the boundary markers in the correct <br />location(s). The operator shall provide proof to the Division that this has been done by the corrective action <br />date. <br />CORRECTIVE ACTION DUE DATE: 6/01/18 <br />OBSERVATIONS <br />This was a routine monitoring inspection for the Shipps Pit permit, a 9.4 acre 110c sand and gravel operation, <br />conducted by Eric Scott of DRMS. DRMS met permittee representative Jim Cozad and observed the site with <br />him at approximately 12:00. The site identification sign was observed at the existing south site entrance <br />location (photo 1). <br />The extent of the site boundary was marked with posts, although they appear to be incorrectly located as stated <br />above. The markers will need to be adjusted as necessary to encompass a maximum area of 9.4 acres as shown <br />on the attached map. <br />The site is active although no mining was taking place during this inspection. Approximately 4 acres within the <br />permitted area are currently disturbed, and the topsoil and overburden have been stockpiled along the perimeter <br />of the excavated areas. The eastern portion of the permit area appears to have been disturbed at some point in <br />the past (possibly pre -law) but would be considered to be reclaimed at this time - with the exception of the 0.1 <br />acre area of exposed groundwater as previously noted. This area will need to be filled to eliminate exposed <br />groundwater to comply with State Engineer's Office Division of Water Resource requirements. <br />If the permittee wishes to continue mining activity within this permit area, DRMS will need to recalculate the <br />required reclamation bond as previously stated on the first page of this report. However, it should be noted that <br />most of the remaining material within the existing permit area may be required to restore the existing 880 foot <br />high -wall to the 2:1 slopes currently required in the reclamation plan. The permittee may wish to submit a <br />technical revision to DRMS to modify the final reclamation slope to 3:1 or flatter to minimize the amount of <br />sloping/backfill required. Even with a revised slope configuration, the increase to the bond will likely be <br />substantial relative to the amount currently posted due to the length of time since it was Iast adjusted. <br />Issues noted during this inspection that will require corrective action have been noted in the previous section of <br />this report and additionally documented with the following photos. A corrective action date of June 1, 2018 has <br />been given to resolve the observed issues. <br />Other than the issues previously noted, mining appears to be in compliance with the approved plan at this time. <br />Representative photos of site conditions have been attached to this report. <br />Page 2 of <br />
