The area of the channel embankment that has been documented as 'bare <br />of rip rap' is considered a maintenance item and does not rise to a violation. Additionally, the Division has only conducted <br />rough measurements of the Magpie Diversion and not a survey of the ditch. Currently, the Division and the Office of Surface <br />Mining Reclamation and Enforcement will be conducting a survey of the Magpie Diversion on a tentative date of April 4, <br />2018. Finally, based on the inspections conducted by the Division since August 2001 and the approval of the Magepie <br />Creek Diversion as a permanent drainage, there are no reasons to believe imminent danger or harm exists. However, the <br />Division will be conducting its monthly inspection of the Southfield Mine on March 30, 2018 at 9:00 AM which is within 10 <br />days of receipt of your inspection request. <br />Additionally, there have been recent organizational changes within the Division. The permit <br />violation issues are listed below. <br />1. The Diversion was constructed as a temporary diversion and surveyed in 1982. This survey was reproduced for <br />Southfield in 1989 and was used for the certified as -built Southfield Map 25. It is impossible for this certification of the <br />temporary diversion to be used for the certification of the permanent diversion construction done in 2001. There has <br />never been a certification of the permanent Diversion by a qualified and registered professional engineer as required by <br />4.05.4(2) and 4.05.4(4). <br />2. There is an area on the north Diversion bank that is bare of rip -rap. This bare area has been noted in the monthly <br />Southfield inspection reports as requiring repair for about fifteen consecutive monthly reports. <br />3. The north bank of the Diversion has less than the required freeboard as specified in the Southfield Map 25A. A <br />survey certified by John H. Keilers, professional land surveyor, 23890, dated July 11, 2016, has been furnished to you. <br />The inadequate freeboard height was confirmed by subsequent measurements performed by the Division. <br />4. The Diversion discharge culvert beneath the Monarch Fan Road has a damaged inlet, which damage reduces the <br />inlet cross sectional area. The Federal Highway culvert tables do not provide flow data for damaged inlets, but it <br />seems probable that the reduced inlet area will thereby decrease the flow and increase the inlet head water height. <br />5. The Diversion of Magpie Creek does not return the water to the original Magpie Creek at the culvert inlet. Instead <br />the Diversion flow joins an unnamed creek at the culvert outlet, and the Diversion flow continues about three-quarters <br />of a mile downstream, outside the Southfield permit area, and across the neighboring Warnock property where it rejoins <br />the original Magpie Creek. <br />This inspection request if being made now because of the approaching rainy season.
