TAB 11 <br />FISH AND WILDLIFE RESOURCES <br />Introduction <br />The Hayden Gulch coal handling and rail facility was originally permitted by the Colorado Mined <br />Land Reclamation Division, precursor to the Colorado Division of Reclamation, Mining and <br />Safety (CDRMS) in 1982 in conjunction with the Hayden Gulch surface coal mine. Permit No. C-80- <br />003 was successfully renewed in 1987, 1992, 1997, 2002, 2007, and 2012 although the coal handling <br />facility had not been operated for several years. <br />The original baseline fish and wildlife information contained in the application for Permit C-80-003 <br />was developed by the 3R Corporation. The information was derived from a quantitative and <br />qualitative biological inventory of the Hayden Gulch mine -site, a comprehensive literature review, <br />and consultation with the Colorado Division of Wildlife (CDOW) and other entities knowledgeable <br />about the ecology of the area. <br />Disturbances associated with construction of the loadout and rail facility were essentially completed <br />prior to the issuance of the original permit; consequently, no quantitative studies were conducted <br />of fish and wildlife or their habitats within and adjacent to the loadout permit area. <br />Tab 11 presents available information on fish and wildlife resources to support Hayden Gulch Terminal, <br />Inc.'s permit application to operate the loadout facility. The information addresses the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining at Rule 2.04.11 <br />regarding the requirements for information on fish and wildlife resources in permit applications. <br />This information was used to develop a fish and wildlife plan as required at Rule 2.05.6(2), and <br />addresses the protection of fish, wildlife, and related resources as required at Rule 4.18 (see Tab 21, <br />Fish and Wildlife Plan). <br />The fish and wildlife information contained herein was derived from several sources including: <br />1. The report of a baseline biological inventory for the proposed Hayden Gulch Mine <br />contained in the original package for Permit No. C-80-003 at Volume V, Appendix M (report <br />prepared W.R. Grace and Company by the 3R Corporation, May, 1977). <br />2. The summary report of a baseline wildlife inventory for the proposed Hayden Gulch Mine <br />contained in the original application package for Permit No. C-80-003 at Volume IIl, <br />Appendix H (report prepared for W.R. Grace and Company by the 3R Corporation, June <br />1977). <br />3. Consultation with CDOW, CDRMS, and the U.S. Fish and Wildlife Service (USFWS) <br />during the course of preparing HGTI's pen -nit application package for C-92-081. <br />4.
