HaydenGulch Terminal, LLC will pay <br />any applicable Abandoned Mine Land Reclamation fees. <br />Rule 2.03.4(3) Ownership and Control of Hayden Gulch Terminal, LLC. Hayden Gulch Terminal, <br />LLC (HGT) is owned by American Land Holdings of Colorado, LLC. American Land Holdings <br />of Colorado, LLC is wholly owned by American Land Development, LLC which is <br />w h o 11 y o w n e d b y Peabody Investments Corporation, which is wholly owned by Peabody <br />Energy Corporation. Ownership and control information for the HGT - Peabody Energy <br />corporate structure is presented in Attachment 3-2. <br />Officers and directors for Hayden Gulch Terminal, LLC and its parent companies are typically <br />elected or appointed at the annual Board of Directors meeting.
