Proposed Topsoil Pile 36A has been included in the cumulative bond schedule, Exhibit <br />13C When reviewing proposed Map 28C — Topsoil Handling, all topsoil associated with <br />proposed Topsoil Pile 36A is to be stripped and placed back to the dated mining block of <br />2022 — 2024. However, as discussed with the pending Renewal No. 7 process, the <br />Division will be bonding for all disturbances associated with current disturbances as well <br />as up to the current permit term (years 2017 — 2021) with pending Renewal No. 7. Please <br />provide the Division additional explanation for the inclusion of Topsoil Pile 36A within <br />Exhibit 13C. <br />Response: The Division is correct in their assumption about Topsoil Pile 36A, and it <br />should be covered in the overall reclamation liability for the entire mine site, but not for <br />the cumulative bond schedule or worst case scenario for the permit term. Therefore, <br />Topsoil Pile 36A has been removed from Exhibit 13C. Please remove Topsoil Pile 36A <br />form the Exhibit 13C reclamation cost estimate also. <br />9. On proposed page 13 of Exhibit 13C, discussion states that the provided information is <br />through the end of year 2020. Similarly, to Item 8 of this letter, the Division will be <br />bonding for all disturbances associated with current disturbances as well as up to the <br />current permit term (years 2017 — 2021) with pending Renewal No. 7. The Division feels <br />that the differing dates can lead to confusion with the reclamation cost estimate with no <br />defining disturbance limits associated with 2020 within the Colowyo PAP. Please provide <br />defining disturbance limits for the disturbances associated with the proposed activities <br />within Exhibit 13C. <br />Response: Per phone discussion between Mr. Tony Tennyson and Mr. Zach Trujillo in <br />regards to this comment a map (Map 13C-1) has been prepared and included in Exhibit <br />13C to identify the areas planned for disturbance under Exhibit 13C. The Division <br />should note that this area will be a smaller disturbance footprint that is contained on Map <br />35B in RN -07. Colowyo fully understands the areas shown on this map and contained in <br />Exhibit 13C will be the limiting factor of disturbance allowed until Exhibit 13C is <br />updated or Colowyo's post the full bond amount required for the permit term. <br />10.
