The current SWSP amendment for the Morton-Holton Lakes
Mine was approved on November 21, 2017 to cover operations from October 1, 2017 through
December 31, 2018. In the current SWSP, RMCC had planned to continue to de-water its Stage
6B through the end of 2018. However, RMCC now plans to partially fill Stage 6B by direct
diversions from the South Platte River under free river conditions. If the call comes on prior to
reaching the planned incremental fill depth of 12 feet above the bottom elevation of the Stage 6B
mine area, RMCC will hold any water elevation it reaches prior to the call by installing a culvert
at the free river storage volume level in the berm that will separate Stages 6A and 6B. The
culvert will drain water into Stage 6A,where it will be dewatered into the South Platte.
RMCC's current water lease schedule with the City of Aurora provides replacement water in
excess of the current augmentation requirements under the current SWSP. Because Stage 6B
will be filled by direct diversions of free river water and not through ground water infiltration,
there will be no lagged fill depletions. The additional augmentation supplies already available
under the existing contract with the City of Aurora are sufficient to replace the additional lagged
net evaporation depletions resulting from the additional surface area at Stage 6B and no new
augmentation supplies are needed for this amendment. RMCC is therefore requesting approval
of the proposed amendment to the existing SWSP from March 1 through December 31, 2018 to
allow for the additional evaporation at Stage 6B that is expected and for possible additional
surface area at its existing mine stages through the end of the approval period within the
