Randall, Executive Director | Virginia Brannon, Director 1313 Sherman Street, Room 215 Denver, CO 80203 March 19, 2018 Dave Rice Delta County Planning and Development Planning Director 501 Palmer Street, Suite #115 Delta , CO 81416 Re: Terror Creek Loadout (Permit No. C-1983-059) Permit Renewal Application No. 7 (RN-7 ) Dear Delta County Planning and Development: The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on March 19, 2018, an application to renew an existing permit to conduct coal mining operations at the Terror Creek Loadout was considered complete for the purposes of filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. Oxbow Mining, LLC proposes to continue loadout coal mining and/or reclamation operations on land located approximately 4 miles Northeast of Paonia, Colorado. The permit area is further described as follows: Portions of Section 15, Township 13 South, Range 91 West of the 6th P.M.. The above-mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle map(s): Abarr. This renewal application does not propose revisions to the approved mining and reclamation plan, nor is there any proposed surface disturbance outside of the currently approved disturbance area.
