Most importantly for compiling the bid document for
anticipated construction, DMG needs to know if the BLM is willing to enter into a Task
Order agreement regarding the anticipated additional cost for the construction of bat
grates versus backfilling. As previously stated in the earlier correspondence, the bid
document schedule will currently contain solicitation for both closure techniques. If a
response is not received by DMG prior to the solicitation for bidding and award process,
per reclamation plan and by State statute, the site will be reclaimed per reclamation plan
submitted in the mining permit. As also previously stated, the reclamation plan in the
permit lists, and the bond was calculated/based on the backfilling of all eleven(11)
identified features (5 portals, 6 vent holes). Furthermore, if response is not received prior
to initiating construction, reclamation work will proceed to the best ability the available
bond forfeiture funds will allow according to the permit s reclamation plan.
Again, solicitations are planned to occur late March with reclamation construction
targeted for late April, 2004. Looking forward to hearing from you.
Sincerely,
Paul Krabacher
Inactive Mine Program
cc. Jim McArdle, DMG Denver
Office of Office of Colorado
