' EXHIBIT 23
Aggregate Industries—WCR, Inc.
' Page 3
2/29/2015
Location o
Permanent nW
MW-1 •,, ;
.'i " ♦
j X
/ Legend
! r Ap m•le PamM1 Bound ry
If—ft Bull
.. ",•, 14.1-1•C Bull B••p
' ro ` `Slum.•u
225 450 BeF
Figure 1: Map of the Hazeltine Mine,Wells MW-2,MW-3 and MW-11B are shown on the map,the proposed
location of the Permanent Plan is also identified(all locations are approximate).
' Monitoring wells MW-2, MW-3, and MW-11B are proximal to the location of the proposed
Permanent Plan and represent the pre-mining/pre-slurry wall groundwater elevations in the
immediate area. Prior to the installation of the slurry wall the average groundwater elevation
' for monitoring well MW-2 was 5035.96 feet(5.63 feet below ground surface);well MW-3 was
5,037.69 feet(10.58 feet below ground surface); and well MW-I I was 5,036.9 feet(2.63 feet
below ground surface).
The Permanent Plan proposes setting the invert elevation of the two 18-inch ADS pipes at ground
surface, at an elevation of 5,038.8 feet in the Bull Seep. The Permanent Plan appears to address
' surface water at an elevation which is significantly higher than the average pre-mining/pre-slurry
wall groundwater elevation observed in monitoring wells MW-2, MW-3, and MW-1113.
Therefore, the proposed Permanent Plan fails to minimize the impacts to the prevailing
groundwater system as required by C.R.S. 34-32.5-116(4)(h), Rule 3.1.6 and the corrective
actions of Violation No. MV-2015-003.
' Pursuant to C.R.S.34-32.5-116(4)(h),Rule 3.1.6,and the Board Order,please provide a Permanent
Plan that will lower the groundwater elevation along the eastern portion of the Hazeltine Mine to
an elevation that matches or closely mimics the average pre-mining/pre-slurry wall groundwater
