Transit Mix Concrete Co. <br /> Responses to Colorado Parks and Wildlife, History Colorado, Colorado State <br /> Land Board, and Division of Water Resources Comments <br /> Colorado Parks and Wildlife <br /> Transit Mix commits to conducting migratory bird and raptor surveys prior to starting each <br /> mining phase as requested by Colorado Parks and Wildlife. If any nests are located in the <br /> disturbance area, Transit Mix will consult with CPW and USFWS prior to disturbance. <br /> History Colorado <br /> Transit Mix informally coordinated with the State Historic Preservation Office at the time of the <br /> cultural resources inventory, and SHPO concurred with the findings presented in the report. Out <br /> of an abundance of caution, Transit Mix has again provided SHPO with the cultural resources <br /> inventory and requested additional consultation in conjunction with the 404 permit application <br /> process. Transit Mix will provide the Division the results of this additional consultation. <br /> In response to the letter from History Colorado, Transit Mix commits to coordinate with the <br /> Office of Archaeology and Historic Preservation in the unlikely event that human remains are <br /> discovered. <br /> Colorado State Land Board <br /> The letter from the Colorado State Board of Land Commissioners supports the mining permit <br /> application, and Transit Mix agrees with the benefits, mitigation of short-term impacts, and the <br /> assessment on the Legal Right to Enter discussed in the letter. <br /> Division of Water Resources <br /> The letter from the Division of Water Resources supports Transit Mix's demonstration that <br /> impacts to the overall hydrologic balance have been minimized by returning intercepted <br /> groundwater to Little Turkey Creek without consumption, purchasing water used onsite from <br /> Colorado Springs Utilities, and complying with the Division of Water Resources' requirements <br /> and limits for storm water detention. Transit Mix commits to complying with these storm water <br /> management requirements. Transit Mix also commits to avoiding adverse impacts to water <br /> resources or vested water rights, and Transit Mix will consult with the local Water Commission <br /> if the operation might affect the flow of water to any stream and/or ditch. <br /> Transit Mix also applied for a Substitute Water Supply Plan (SWSP) with DWR, and DWR <br /> determined the impacts to groundwater resources to be de minimus and a SWSP was not <br /> necessary. <br /> Hitch Rack Ranch Quarry(M-2017-049) <br /> Response to Comments—March 9,2018 <br />
