Neither the Act nor the <br /> regulations require an Applicant to "obtain from owners of record" a legal right to enter. <br /> Second, Paragraph 41 also refers to the road easement as the "dominant estate." This is <br /> also a mistake of law. As set forth in Exhibit N to the permit application, the road <br /> easement is not the dominant estate in relation to the mineral interests held by Applicant. <br /> 2. In the Pre-Blast Survey Procedure section of the Pre-Blast Survey Plan, the Applicant states <br /> the survey will be offered to the neighbors of Hitch Rack Ranch Quarry where a structure is <br /> located within three-quarters (3/4) mile of the permit boundary (north and west of the scale <br /> house) at no cost to the owner. The Pre-Blast Survey notice letter included in Appendix A of <br /> the Pre-Blast Survey states the Applicant is offering a pre-blast survey to every resident and <br /> owner of a structure within the pre-blast survey radius of one-half (1/2) mile from the <br /> proposed disturbance boundaries of the mine permit. Please revise the Pre-Blast Survey notice <br /> letter to indicate a pre-blast survey distance of within three-quarters (3/4) mile of the permit <br /> boundary. <br /> Response: Appendix A of the Pre-Blast Survey Plan has been revised to specify a distance <br /> of three-quarters (3/4) mile from the permit boundary. <br /> 3. On at least one Exhibit C — Mining Plan Map, please indicate the three-quarter (3/4) mile <br /> offset from the permit boundary (north and west of the scale house). <br /> Response: Exhibit C-2b has been added to show the three-quarter (3/4) mile offset from <br /> the permit boundary and each house located within this area. <br /> 4. Please provide a list of all structure owners and structures located within three-quarter (3/4) <br /> mile offset from the permit boundary (north and west of the scale house). <br /> Response: A list of all current structure owners and structures located within three-quarter <br /> (3/4) mile offset from the permit boundary (north and west of the scale house) has been <br /> included in Exhibit C as Table C-2b. <br /> 5. The Division did not receive the contents of the Pre-Blast Survey Plan Appendix B. Please <br /> provide the Division with Appendix B of the Pre-Blast Survey Plan. <br /> Response: The Pre-Blast Survey Plan has been resubmitted to include Appendix B. <br /> 6. In the Documentation section of the Blasting Plan, the Applicant states a third party blasting <br /> contractor will prepare a paper record of each blast completed at the quarry. Please confirm the <br /> blasting reports will contain the following minimum information: <br /> a.Name of the operator conducting the blast <br /> b. Location, date, and time of blast <br /> c. Name, signature, and license number of blaster-in-charge <br /> d. Identification, direction and distance, in feet, from the nearest blast hole to the nearest <br /> permanent man-made structure <br /> e.
