This,when <br /> approved,will transfer the permit from Rick Hunt's Estate to Schmidt Construction Company. Schmidt has <br /> been the actual operator of this pit for many years and operated under a contract with the landowner,Rick <br /> Hunt,who held the permit. After Rick's passing away the permit became the property of Rick's estate and,as <br /> you are aware,it has been a long and complex process of resolving that. The land is now in the ownership of <br /> Colorado Farms LLC and they and Schmidt have entered into a lease agreement that uses the original wording <br /> in the lease Schmidt had with Mr. Hunt. But it was also agreed that Schmidt would assume the permit rather <br /> than Colorado Farms. So,this succession of operator will remove the Estate from any responsibility for the <br /> Miller Pit which is appropriate as they no longer have control of the property. <br /> I want to thank you and Amy for all your help and support in bringing this complex matter to a conclusion <br /> that is consistent with the reclamation law.
