This dispute includes ten lode claims located at the base of Mr. Sopris along <br /> Avalanche Creek which the parties refer to as the White Banks Claims. Plaintiffs <br /> Exhibit 93 depicts the general location of these claims. <br /> Also at issue are the lode claims that the parties refer to as the Southern Claims. <br /> The Southern Claims are on Elephant Mountain, south of the White Banks Claims, and <br /> consist of the Top Deck, Bottom Deck, West Deck, East Deck, Ground Hog, Double <br /> Decker, and the Maree Love claims. <br /> Lastly, are the placer claims which overlie the White Banks and Southern lode <br /> claims which Snowmass claims they own. <br /> FINDINGS OF FACT <br /> THE PARTIES <br /> Plaintiff Snowmass Mining Co., LLC (hereinafter"Snowmass Mining") is an Idaho <br /> limited liability company, registered to do business in Colorado. Julie Otis Skinner and <br /> Donald Skinner are co-managers and co-members of Snowmass Mining. <br /> Mystic Eagle Quarry, LLC is a Colorado limited liability company. Mr. Congdon is <br /> the majority owner. <br /> Robert Congdon is the majority owner of Mystic Quarry and Elbram Stone. <br /> Julie Otis Skinner used to be married to Robert Congdon. They married in 1988. <br /> They divorced in 1994. Julie Otis Skinner is now married to Donald Skinner. <br /> THE WHITE BANKS LODE CLAIMS <br /> Mr. Congdon testified that he first found an alabaster deposit at the White Banks <br /> Claims in 1978. <br /> 2 <br />
