On June 28, 2005, Julie Skinner completed location certificates for each of the <br /> ten (10) White Banks Claims on behalf of herself and their two children. These ten <br /> locations certificates were then filed with Pitkin County on June 29, 2005. (See Exhibit <br /> 34). <br /> In August of 2005, the Skinners hired a professional mining company called <br /> Minex to perfect the ten (10) White Banks Claims. Greg Schifrin is the owner of Minex. <br /> Mr. Schifrin sent Clarity Coffman and Jon Waldrup to the White Banks claims to perform <br /> the work. Mr. Schifrin did not personally go to the site at that time but he was directing <br /> what Ms. Coffman and Mr. Waldrup were supposed to do by telephone. Ms. Coffman <br /> tested that she and Jon went to the White Banks Claims in August of 2005 to stake <br /> the claims for Snowmass. They had arranged for a helicopter to go to the site and used <br /> the helicopter to drop the stakes on the claims. Exhibits 39 through 42 show the <br /> helicopter that they used. Exhibits 43, 44 and 45 show the stakes that they used to <br /> mark the claims. Exhibits 46 and 48 show how they dropped the stakes from the <br /> helicopter. After the stakes were dropped on the ground, she and Jon went in by foot to <br /> where the stakes were and staked the claims. Exhibits 53 through 64 show the stakes <br /> that they put on the claims. Ms. Coffman testified that she took all of these photographs <br /> and it was standard procedure to document their field work with a photograph. Each <br /> stake had a metal tag and an orange ribbon attached to it. An orange ribbon is used so <br /> people walking by can easily see the stake and know that a mining claim is there. At <br /> each stake, a film canister was also placed which contained the location certificates. <br /> At the end of the first day of staking, Ms. Coffman and Jon were confronted by <br /> Mr. Congdon as they walked to their car. Mr. Congdon accused them of claim jumping <br />
