This, when <br />approved, will transfer the permit from Rick Hunes Estate to Schmidt Construction Company. Schmidt has <br />been the actual operator of this pit for marry years and operated under a contract with the landowner, Rick <br />Hunt, who held the permit. After Rick's passing away the permit became the property of Rick's estate and, as <br />you are aware, it has been a long and complex process of resolving that. The land is now in the ownership of <br />Colorado Farms LLC and they and Schmidt have entered into a lease agreement that uses the original wordwg <br />in the lease Schmidt had with Mr. Hunt. But it was also agreed that Schmidt would assume the permit rather <br />than Colorado Farms. So, this succession of operator will remove the Estate from any responsibility for the <br />Miller Pit which is appropriate as they no longer have control of the property. <br />I want to thank you and Amy for all your help and support in bringing this complex matter to a conclusion <br />that is consistent with the reclamation law.
