STRUCTURE AGREEMENT <br />RECEIVED <br />FEB 28 <br />DIVISION OF RECLAMATION <br />YININGAND SA M <br />for <br />MILLER GRAVEL PIT SUCCESSION OF OPERATOR <br />This fornn has been Provided to you as the owner of valuable man-made structwes thin <br />wi <br />200 feet of the permit for the Miller Gravel Pit which is also on your Pr OP <br />The State of <br />s <br />Colorado, Division of Reclamation, Mining and Safety ("Division" re <br />operation will potentially affect the s#abili of an svaluable <br />} req that wen an <br />hen a mining located within two hundred {240} feet of the affected I nd the Applicant shad ei-made <br />a.) Provide a notarized agreement between the Applicant and the P01-son(s) having an <br />interest in the structure, that the Applicant is to provide compensation for any <br />damage to the structure; or <br />b.) Where such an agreement cannot he reached, the Applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occuxxing at the mining operation; or <br />c-) Where such structure is a utility, the Applicant may supply a notarized letter, on <br />utility letterhead, from the owner(s) of the utility that mining and reclamation <br />activities, as proposed, will have "no negative effect" on the utility. <br />( COnstrrcctian Materials Rule 6.3.1.2 and Rule 6.419 ) <br />The Coloradolvlined Land Reclamation Board (".hoard"} has determi�eed that this form, <br />'fproperly axe 0uled, represents an agreement that co)nplies ,vith Construction Materials Rude <br />6.3.12(a), Rule 5.4.19(x), orad C.R.S. § 34-3?.5-115(4)(e). This form is for the sale purpose of <br />ensuring compliance with the Mules and Regulations and shall not make the Boardar 1�rvisior�a <br />necessary party to any private civil lawsuit to eiiforce the terms o, f'the agree rnent or create any <br />en,forcernent obligauans in the Board or the Division. <br />The following structures are located on or within 240 feet of the proposed affected area <br />(these are noted in red on the attached map). <br />I. All. perimeter fences that fallow the permit boundary. (These are technically outside the permit') <br />2. Connecting fences: 2 on the south side, I on the north side, and 2 along the entrance road at the <br />west entrance to the operation. <br />3. Cattle Guards: I each at the west and south entrances to the operation <br />4. Four poles of the private power line that feeds the scale house and former Hunt Construction <br />Buildings. Includes electrical wires convecting the poles. <br />
