DIPUTWM Of TM MR*IOR <br />�1MF1Y Of UiNO M�M�OMM(M <br />Denver, CO 80202 <br />RE: Proposed Decision of the Colorado Division of Reclamation, Mining and Safety (CDRMS) <br />SL -06 Bond Release at the Bowie No. 1 Mine, PN C-1981-038 <br />Dear Mr. Strand: <br />This is to inform you that my staff has reviewed the CDRMS "Proposed Decision Notice" dated February <br />15, 2018. On September 21, 2018 Desty Dyer participated in a joint CDRMS, OSM, BLM, and Bowie <br />inspection which included 8 drill pads on BLM managed surface that were part of old exploration <br />licenses and permits that are closed cases. We are aware that among the total of 2.31 acres of Phase I <br />bond release that none of the 8 drill sites on BLM would determine the outcome of the SL -6 bond release <br />because they were not bonded under the C-1981-038 permit. The CDRMS has no acreages associated <br />with those pads as a part of the bond. <br />Regarding the 58.84 acres of Phase Il bond release we determined that approximately 10.6 acres of gob <br />and/or waste disposal area as well as approximately 5.6 acres of haul road bank for a total 16.2 acres <br />were on BLM managed surface. <br />The coal mined was a combination of private owned by Bowie Resources and federal mineral estate <br />managed by the BLM. The acres included in the bond release area had improvements that served their <br />useful purpose and were no longer necessary since the coal reserves had been mined out and the mined <br />out workings had been abandoned. In addition, the reclamation appears to be properly carried out as <br />reported. <br />Regarding the Phase II portion of the bond release on BLM managed lands, the BLM has no objection <br />to the Bond Release.
