Larsen <br />Kilgore Companies, LLC dba Elam Construction <br />556 Struthers Ave <br />Grand Junction, CO 81501 <br />IM Iq?Ll Ii <br />RE: Sunny Side Gravel Pit, Permit M-1986-160, Incomplete Application for Transfer of <br />Mineral Permit and Succession of Operators, Option two, Revision SO -01 <br />Dear Mr. Larsen, <br />On February 23, 2018 the Division of Reclamation, Mining and Safety received the Application <br />Form for Transfer of Mineral Permit and Succession of Operators from Parkerson Construction, <br />Inc. to Kilgore Companies, LLC dba Elam Construction, for the Sunny Side Gravel Pit, Permit M- <br />1986-160. The following items are incomplete for the application to be processed: <br />1. Application fee of $144.00 not received for a 110c Construction Materials site. <br />2. Notary acknowledgement for application, Performance Warranty and Financial Warranty <br />lack complete successor permittee name. Pages enclosed for correction to include <br />Kilgore Companies, LLC dba Elam Construction. <br />3. Right of Entry- In Exhibit A the Sunny Side Pit and associated acreages list parcels <br />numbers 2667-321-00-266 and 2667-332-00-122 for lands associated with this mining <br />operation. According to the Mesa County Assessors website these parcels are owned by <br />Mosquito Creek Ranch LLC, not A It G Partnership, LLP. The lease agreement included <br />with this application is between Kilgore Companies, LLC and A Et G Partnership, <br />LLP. Kilgore Companies, LLC dba Elam Construction will need an additional lease <br />agreement for the parcels owned by Mosquito Creek Ranch LLC. If A lir G Partnership, <br />LLP wishes to sublease to Kilgore Companies, LLC dba Elam Construction they must first <br />provide documentation that this is permitted under their lease with the landowner. <br />4. Structure Agreements were not provided for man-made structures, utilities and roads <br />within 200 ft. of the affected land. See instructions enclosed for Structure Agreements. <br />5. Affidavit of Authority for Russell A. Larsen to execute the financial warranty. <br />Please return the required documentation to the Division before April 27, 2018 to complete the <br />application for approval.
