Or, where <br />such an agreement cannot be reached the Applicant shall provide an appropriate <br />engineering evaluation that demonstrates that the waterline shall not be damaged <br />by activities occurring at the mining operation. The Applicant may supply a <br />notarized letter on utility letterhead,from the owners of the utility that the mining <br />and reclamation activities, as proposed, will have "no negative effect on their <br />utility. <br />Response 3b <br />The West Fort Collins Water District is relocating this waterline away from the Knox pit, <br />and the new water line will not be impacted. The location of the new easement for this <br />water line is near the existing West Fort Collins District water line shown on the west <br />side of the mining boundary on Exhibit C. The plan currently calls for a 100-foot mining <br />setback from the property line, which equates to a 50-foot setback from the new pipeline <br />easement.
