COMPLIANCE INFORMATION
Pursuant to Rule 2, Section 3.5(3) of the Regulations of the Colorado Mined Land Reclamation Board
for Coal Mining, the attached is a listing of each violation notice received by Seneca Property, LLC
for the period September 1, 2014 to September 1, 2017 for any violation of a provision of the Act, or
of any law, rule, or regulation of the United States, or of any State law, rule, or regulation enacted
pursuant to Federal law, rule, or regulation pertaining to air or water environmental protection incurred
in connection with any surface coal mining operation. A list of all unabated cessation orders and
unabated air and water quality violation notices received prior to September 1, 2017 by any surface
coal mining and reclamation operations owned or controlled by either Seneca Property, LLC or by any
person who owns or controls Seneca Property, LLC is also included.
For each violation notice or cessation order reported, the list includes the following information:
Any identifying numbers for the operation, including the Federal or State permit number and
MSHA number, the dates of issuance of the violation notice and MSHA number, the name of the
person to whom the violation notice was issued, and the name of the issuing regulatory authority,
department, or agency;
2. A brief description of the particular violation alleged in the notice;
3. The date, location, and type of any administrative or judicial proceeding initiated concerning the
violation, including, but not limited to, proceedings initiated by the applicant to obtain
administrative or judicial review of the violations;
4. The current status of the proceedings and of the violation notice;
5. The actions, if any, taken by the applicant to abate the violation; and
6. The final resolution of any notice of violation.
It should be noted that the attached represents a complete listing of the above-described violation
notices or cessation orders and their status as reflected by the file of the Office of the General Counsel
of Peabody Energy Corporation., 701 N. Market Street, Suite 700, St. Louis, Missouri 63101-1826, as
of September 1, 2017. Seneca Property, LLC reserves the right to supplement this listing to reflect
any information received by the Office of the General Counsel after said date.
The following section also lists any suspended or revoked State or Federal mining permits over the
past five years for either Seneca Property, LLC or any companies in the Organizational Family Tree
(Attachment 3-2).
