Kinzer', CO 80117 <br /> Belveal Gravel Pit Expansion Agreement <br /> THIS AGREEMENT is entered into this GP day of A.7__D ,by 01949/ 7 <br /> And between Elbert County Government("County")and Robert Belveal ("Property Owner"), <br /> for the purpose of operating a gravel pit on the property in Elbert County,Colorado_ <br /> WHEREAS,Property owner is the owner of certain property in Elbert County. The <br /> Property Owner wishes to allow the County to operate a gravel pit on the following described <br /> property: <br /> The pit will include 9.9 acres of the old piton SW4.Sec 6.T13.RS8(legal description)and 150 <br /> acres of the netiv_expansion on SW4.Sec 6.T13. R58(legal description)and T13S,R59W.Sec 1 <br /> (legal description). <br /> WHEREAS,the County desires to open and operate a gravel pit on Property Owner's <br /> property according to the terms of this agreement. <br /> NOW THEREFORE,in consideration of the promises made herein and other good and <br /> valuable consideration,the parties agree as follows: <br /> 1. The County agrees to do the following: <br /> a)Acquire and maintain the required permits for operation of a gravel pit on the <br /> above described property; <br /> b)Maintain the roads in the pit area used in the operation of the pit,and to <br /> maintain the roads to the gate to the pit; <br /> c) Be responsible for all reclamation of disturbed area as required by the State of <br /> Colorado at the time of the closure of the pit; <br /> d) Pay Property owner on a monthly basis$ 0.60 per cubic yard for gravel or fill <br /> extracted and hauled out of the pit. The parties agree to renegotiate the per cubic yard <br /> fee every five(5)years throughout the duration of the Agreement. If the parties cannot <br /> mutually agree upon a reasonably acceptable fee at the time of renegotiation then the <br /> fee shall increase by five cents(.05)per cubic yard; <br /> 81 <br />
