Removal Work Plan if appropriate in order to correct such deficiencies. Purchaser shall <br /> implement the modified and approved Removal Work Plan and shall submit a modified Final <br /> Report in accordance with the EPA notice. Failure by Purchaser to implement the approved <br /> modified Removal Work Plan shall be a violation of this Settlement. If Purchaser successfully <br /> elects to discontinue its obligations under this Settlement for Phase 2 Work, the procedures set <br /> forth in this Section XXVIII shall only apply as to the Phase 1 Work. <br /> XXIX. INTEGRATION/APPENDICES <br /> 110. This Settlement and its appendices constitute the final, complete and exclusive <br /> agreement and understanding among the Parties with respect to the settlement embodied in this <br /> Settlement. The Parties acknowledge that there are no representations, agreements, or <br /> understandings relating to the settlement other than those expressly contained in this Settlement. <br /> The following appendices are attached to and incorporated into this Settlement: <br /> "Appendix A"is the description and/or map of the Camp Bird Mine Site. <br /> "Appendix B"is the Removal Work Plan. <br /> "Appendix C" is the Trust Agreement. <br /> "Appendix D" is the Lien Forms. <br /> "Appendix E" is the Notice to Successors in Title. <br /> "Appendix F" is the draft Notice of Environmental Use Restrictions. <br /> XXX. NOTICES AND SUBMISSIONS <br /> 111. All approvals, consents, deliverables, modifications, notices,notifications, <br /> objections, proposals,reports and requests specified in this Settlement must be in writing unless <br /> otherwise specified. Whenever, under this Settlement,notice is required to be given, or a report <br /> or other document is required to be sent,by one Party to another, it must be directed to the <br /> person(s) specified below at the address(es) specified below. Any Party may change the person <br /> and/or address applicable to it by providing notice of such change to all Parties. All notices under <br /> this Section are effective upon receipt, unless otherwise specified. Except as otherwise provided, <br /> notice to a Party by email (if that option is provided below) or by regular mail in accordance with <br /> this Section satisfies any notice requirement of the Settlement regarding such Party. <br /> 34 <br />
