Effective Date. Purchaser shall also notify EPA of the name(s) and qualification(s) of any other <br /> contractor(s) or subcontractor(s)retained to perform the Work at least 30 days prior to <br /> commencement of such Work. EPA retains the right to disapprove of any or all of the <br /> contractors and/or subcontractors retained by Purchaser. If EPA disapproves of a selected <br /> contractor, Purchaser shall retain a different contractor and shall notify EPA of that contractor's <br /> name and qualifications within 30 days after EPA's disapproval. <br /> 21. Purchaser has designated Mike Thompson of Reardon Steel, LLC as its Project <br /> Coordinator for Work under this Settlement for Phase 1, and Phase 2 if Purchaser does not <br /> successfully elect to conduct Phase 2 Work pursuant to the DRMS permit. The Project <br /> Coordinator shall be responsible for administration of all actions by Purchaser required by this <br /> Settlement. To the greatest extent possible, the Project Coordinator shall be present on Site or <br /> readily available during Site work. If Purchaser changes its Project Coordinator, EPA retains the <br /> right to disapprove of the new Project Coordinator. If EPA disapproves of the new Project <br /> Coordinator, Purchaser shall retain a different Project Coordinator and shall notify EPA of that <br /> person's name, address,telephone number and qualifications within 30 days following EPA's <br /> disapproval. <br /> 22. EPA has designated Martin McComb of the Emergency Response and <br /> Preparedness Program, Region 8, as its On-Scene Coordinator(OSC). EPA and Purchaser shall <br /> have the right, subject to Paragraph 21, to change their respective designated OSC or Project <br /> Coordinator. Purchaser shall notify EPA 7 days before such a change is made. The initial <br /> notification by Purchaser may be made orally, but shall be promptly followed by a written <br /> notice. <br /> 23. The OSC shall be responsible for overseeing Purchaser's implementation of this <br /> Settlement. The OSC shall have the authority vested in an OSC by the NCP, including the <br /> authority to halt, conduct or direct the Work required by this Settlement or to direct any other <br /> removal action undertaken at the Site. Absence of the OSC from the Site shall not be cause for <br /> stoppage of Work unless specifically directed by the OSC. <br /> VIII. WORK TO BE PERFORMED <br /> 24. Purchaser shall perform, at a minimum, all actions necessary to implement the <br /> Work. The Work shall be implemented in two phases: <br /> a. Phase 1 Work includes: <br /> (1) Stabilizing the historic tailings, as described in the Removal <br /> Work Plan; and <br /> (2) Recontouring the historic tailings and reinforcing the <br /> associated stream banks to the extent necessary to prevent erosion of mine waste from a 100-year <br /> flood event, as described in the Removal Work Plan. <br /> b.
