(:blue earth <br />SOLUTIONS <br />February 2, 2018 <br />Colorado Department of Natural Resources RECEIVED <br />Division of Reclamation, Mining and Safety FEB 0 ; 2018 <br />Attn: Mr. Peter Hays <br />1313 Sherman Street; Room 215 DWSION OF RECLAMATION <br />Denver CO, 80203 MINING AND SAFETY <br />RE: Response to Adequacy Review Comments for Serfer Land Ventures, LLC. <br />Harmony Windsor Site, File No. M-2017-056 <br />Dear Mr. Hays: <br />The following discussion and attachments are submitted on behalf of our client, Serfer Land <br />Ventures, LLC., in response to the Adequacy Review comments prepared by the Division of <br />Reclamation, Mining and Safety (the Division) dated January 24, 2018 and January 30, 2018 for <br />the Harmony Windsor Site Limited Impact Operation (110) Reclamation Permit application. <br />The information and discussion below addresses each comment as it was presented by the <br />Division. <br />DIVISION ADEQUACY REVIEW COMMENTS DATED JANUARY 24, 2018 <br />1.6 Public Notices <br />1. Proof of publication in newspaper is attached. <br />2. Proof of notice to all owners of record of surface and mineral rights of affected land and <br />surface owners and easement holders within 200 feet of the affected land is attached. <br />3. The Colorado Division of Water Resources comments have been reviewed and it is <br />anticipated that (1) no groundwater will be exposed during mining, (2) water trucked to <br />the site will be obtained from a legal source, and (3) stormwater will not be detained in <br />the mining cell for more than 72 hours. <br />6.3.4 Exhibit D — Reclamation Plan <br />4. The financial warranty will be submitted to the Division upon permit application <br />approval. <br />6.3.6 Exhibit F—List of Other Permits and Licenses Required <br />5. Connell Resources, Inc. commits to providing the Division with copies of approved <br />APEN permits. <br />
