Process water: Under certain restrictions, discharges to the ground from construction dewatering, <br />and from concrete washout activities, are also covered (see Parts L C3(c)(7), LC.3(c)(8), LD.3(c) and <br />LD,3(d) of the permit). <br />C. 7' les of r!c_ ti uilic:e N[17 G vetI <br />1. Stormwater: Aside from the sources listed in subparagraph B.1, above, this permit does not cover <br />stormwater discharged from construction sites that is mixed with stormwater froth other- types of <br />industrial activities, or process water of any kind. Other types of industrial activities that require <br />stormwater discharge permits pursuant to different sections of the regulations (Regulation S CCR <br />1002-61, Section 61,2(e)(iii)(A-I, K)J, are not covered by this permit. <br />2. Process water: This permit also does not cover any discharge ofprocess water to surface waters. If <br />the construction activity encounters groundwater, in order to discharge this groundwater to surface <br />waters, a Construction Dewatering Discharge Permit (permit number COG -070000) must also be <br />obtained. An application for this permit can he obtained from the Division at the address listed in <br />Part LA. 4(a) of the permit, or at the website in .Section I of the rationale. <br />V. COVERAGE UNDER THIS GENERAL PERMIT <br />Under this general permit, owners or operators of stormwater discharges associated with construction activity <br />may be granted authorization to discharge stormwater into waters of the State of Colorado. This includes <br />stormwater discharges associated with industrial activityfrom areas that are dedicated to producing earthen <br />materials, such as soils, sand and gravel, for use at a single construction site, and dedicated asphaltplants and <br />dedicated concrete plants. <br />This permit does not pre-empt or supersede the authority of other local, state or federal agencies to prohibit, <br />restrict or control discharges of'stormwater to storm drain systems or other water courses within their <br />jurisdiction, <br />Authorization to discharge under the permit requires submittal of a completed application form and a certification <br />that the SWMP is complete, unless the site is covered by a Qualifying Local Program. Upon receipt of all <br />required information, the Division may allow or disallow coverage under the general permit. <br />VI. APPLICATION AND CERTIFICATION <br />At least ten days prior to the commencement of construction activities, the owner or operator of the construction <br />site shall submit an original completed application which includes the signed certification that the SWMP is <br />complete. Original signatures are required for the application to be considered complete. For small construction <br />sites only, if the site is covered by a Qualifying Local Program (see below), submittal of an application is not <br />required. <br />For the purposes of this permit, the "operator " is the person who has day-to-day control over the project. This <br />can be the owner, the developer, the general contractor or the agent of one of these patties, in some <br />circumstances. At different limes during a construction project, different types ofparties may satisfy the definition <br />of "operator" and the certification may be transferred as roles change, <br />(Note - Under the Federal regulations, this application process is referred to as a Notice of Intent, or NOL For <br />internal consistency with its current program, the Division will continue to use the term "application.') A <br />summary of the permit application requirements is found in the permit at Part I.A.4(b), <br />If'coverage under this general permit is appropriate, then a certification will be developed and the applicant will <br />be certified under this general permit. <br />
