TR -144 proposes no change in the postmining land use on federally owned surface. <br />It is OSMRE's determination that TR -144 does not require a MPDD. Therefore, a mining plan <br />approval from the ASLM is not required. OSMRE's decision is based upon consideration of the <br />Federal regulations under 30 CFR 740 and 746 and not the technical aspects of TR -144. Once active <br />mining is proposed for federal coal leases COC -1362 and COC -67232, OSMRE must be notified <br />and will make another MPDD determination for that action.
