(Tri-State) is the parent company to Elk <br />Ridge Mining and Reclamation, LLC, New Horizon Mine. Therefore, Tri-State is submitting a revised <br />Map 1 and 2 for the Phase III Bond Release Application denoted as SL -19 on behalf of the New Horizon <br />Mine. The New Horizon Mine operates under Permit No. C-1981-008. <br />SL -19 originally applied for 278 acres of Phase III release. Per landowner comments received on <br />the application, the reclaimed haul road area on GW46 Irrevocable Trust and an additional area that a <br />stock pond will need to be constructed at a future date was removed from the application on March 9, <br />2017. This reduced the overall acreage applied for at that juncture to 275.6 acres. <br />Per additional landowner comments a small area exemption was included on the GW46 <br />Irrevocable Trust property through technical revision 83 (TR -83). With the addition of this small area <br />exemption on the GW46 Irrevocable Trust property, the overall acreage being applied for under the SL -19 <br />application is being reduced again due the Division's proposed decision on TR -83 to 272.0 acres. <br />Enclosed please find a revised Map 1 and 2 which reflects the changes noted above.
