Page 2
1 Feb. 2018
Rule: 2.04.8 Baseline Climatological Information
This rule is adequately addressed in the permit.
Rule: 2.05.4(2)(h) Reclamation Plans
Permit sections 2.05 (page 2.05-59), 2.05.3, and 2.03.10 (pages 2.03-20
through ) describe the steps to be taken for compliance with the above
mentioned requirements, discuss monitoring practices and list and present
required permits, respectively; adequately meeting the requirements of Rule
2.05.4(2)(h), with the exception of:
1. As of August 2016 (pg 2.03-21 of the permit) references the NPDES permit as
"Expires: reapplication pending". There are no dates as to when the permit expires
and when the reapplication was submitted. Please either update this page with
additional information or inform DRMS of the status of this permit and the
reapplication process.
Rule: 2.05.6(1), Mitigation of Impacts
Permit section 2.05.3 (pg. 2.05-63) describes the Air Pollution Control Plan
in effect at the Sage Creek Mine meeting the requirements of Rule 2.05.6
(1).
DRMS was unable to locate in the Sage Creek permit a copy of the approved
emissions permit from the Colorado Department of Public Health and
Environment, Air Pollution Control Division.
This may be an outstanding adequacy issue as per question #20 of Permit
Renewal 1.
2.05.6(4) Protection of Public Parks and Historical Resources
Permit section 2.05.3 (pg. 2.05-102) adequately describes the situations
regarding public parks and cultural resources, meeting the requirements of
the rules.
Thank you
Robin Reilley, GISP
