COLORADO
Division of Reclamation,
Mining and Safety
Department of Natural Resources
1313 Sherman Street, Room 215
Denver, CO 80203
January 31, 2018
Doug Smith
Oxbow Mining, LLC
P.O. Box 535
Somerset, CO 81434
RE: Terror Creek Loadout, Permit No. C-1983-059
2017 Annual Hydrology Report Review
Dear Mr. Smith,
The Division of Reclamation, Mining and Safety (the Division) has completed the review of the
2017 Annual Hydrology Report (AHR) for the Terror Creek Loadout. The report was received
by the Division on January 12, 2018, thank you for your timely submittal. The Division finds the
2017 AHR to be in compliance with the following Rules:
Rule 4.05.13(1), (2), (3) and (4), the approved Permit Application Package and the Probable
Hydrologic Consequences (PHC). There are two ponds located at the loadout facility, the P-1
Pond and the Dugout Pond. During the calendar year of 2017 there was no discharge recorded
form either of the two ponds. Discharge Monitoring Reports were submitted to the Division
quarterly and were in compliance with the correct monitoring frequency. There were no samples
taken throughout the year due to there being no flow out of the discharge points. The discharge
points were in compliance with the CDPS permit no. COG -850028. There is no groundwater
monitoring required at the loadout. The 2017 AHR supports the predictions made in the PHC.
Based on the information above, the Division finds that the impact to the hydrologic balance
from the site is at a minimum.
This concludes the Division's review of the 2017 Annual Hydrology Report for the Terror Creek
Loadout.
