for any and all claims arising out of or relating to Lessee's use of the leased <br />premises. Any insurance held by Landowner shall be used only to cpver claim <br />amounts in excess of the required limits of the Primary Policy. Lessee hereby <br />certifies that prior to occupying the leased premises Lessee will be iii compliance <br />with the insurance requirements of this subparagraph 6.2 (a). <br />6.2. (B) Fire and Damage Insurance. Lessee shall, from the Effective Date of this <br />Lease, carry vandalism insurance and fire and damage insurance with extended <br />coverage endorsements covering the full replacement value of all ii4provements <br />placed on the Leased Premises by Lessee. <br />6.2. (C) Workers' Compensation and Occupational Disease Insurance: Applicable <br />Law. Lessee agrees to carry such insurance covering all Lessee's employees <br />working in, on, or in connection with the Leased Premises as will fully comply <br />with the provisions of the statutes of the State of Colorado covering <br />workers' compensation and occupation disease as such statutes are now in force <br />or as they may be amended. <br />6.3. Form and Copies of Policies. Every insurance policy shall be written to protect <br />Landlord and Lessee jointly and shall provide for sixty (60) days wi1itten <br />notification to Landlord prior to its cancellation for any reason including <br />non-payment of premiums. Landlord shall be named as additional insured and loss <br />payees on ail insurance policies covering Lessee's activities on the Teased <br />Premises, excluding the policies under Section 6.2(c). A summary of every policy <br />shall be furnished to Landlord on each anniversary of the Effective Date. Lessee <br />shall pay all premiums and other charges payable with respect to such insurance. <br />6.4. Periodic Review of Bonds and Insurance. Landlord may make a periodic review, <br />at not less than three (3) year intervals, of all bonds and insurance pplicies and <br />coverage amounts held under this Lease. The review shall give conoideration to the <br />economic conditions at the time and may result in adjustment of thei types of bonds <br />or insurance coverage or the amounts of any coverage whenever in the discretion <br />of Landlord an adjustment is necessary for the protection of Landlord <br />7. INDEMNIFICATION; HOLD HARMLESS. <br />7.1. Lessee agrees to indemnify and to hold Landowner harmless from any and all <br />claims, causes of action, damages, penalties, and costs (including attorneys' fees, <br />consultant fees, and related expenses) which may be asserted against or incurred <br />by Landowner resulting from any injury, damage, incident, or activkdes on the <br />leased premises caused by Lessee. Lessee's duty to indemnify and hold harmless <br />includes, but is not limited to, proceedings or actions commenced by any person <br />(including any federal, state, or local governmental agency or entity), before any <br />court or administrative agency.
