determined at the rate of 4 % of the average retail price of 1 '/z inch fill from the <br />two largest gravel suppliers in the area <br />4. TERMNATION OF LEASE. <br />4.1. Removal of Stockpile. Landowner covenants and agrees that upon expiration of <br />this Agreement, that any stockpiles of processed rock, sand, and gravel material <br />shall remain the property of Lessee, and that Lessee shall continue .to have rights <br />of ingress and egress to remove material from stockpiles until such stockpiles are <br />depleted or March 31, 2092, whichever occurs first. <br />4.1. (A) It is understood that Jared may stockpile materials, and payments thereon <br />are not payable until removal from the premises, provided the Lessee removes <br />material from premises by the deadline set forth in Paragraph 4.a., above. In the <br />event any stockpile exists at the termination or expiration of this Agreement, then <br />Lessee shall have the right to remove same on or before March 31, 2091, and pay <br />amounts due to Landowner upon removal as provided in paragraph 3 above. <br />Any such stockpile not removed by Lessee as set forth in this Paragraph 4 shall <br />remain the property of Landowner on April 1, 2092. <br />4. 1. (B) Lessee shall remove and stockpile the overburden and/or topsoil and <br />replace such at the termination of this Agreement. On or before June 30, 2091, <br />Lessee shall grade the disturbed area slope pit area, remove all machinery, and <br />return the premises to as near as possible to an original state comparable to the <br />state of un -mined portions of the premises and adjoining lands. Notwithstanding <br />the foregoing, with regard to stockpile areas and the established ingress and <br />egress route thereto, Lessee's obligation to complete its reclamation of those <br />specific areas shall not take effect until stockpiles have been substantially <br />removed, and Lessee shall have ninety (90) days thereafter to complete <br />reclamation of such areas. Notwithstanding any other provision of this Agreement <br />to the contrary, Lessee's reclamation obligations shall survive the expiration or <br />termination of this Agreement. <br />4.2. Clean Up of Property. On termination of operations under this lease, the Lessee <br />shall make provisions for the conservation, repair and protection of the property <br />and leave all of the areas on which the Lessee has worked in a condition that will <br />not be hazardous to life or limb, subject to an inspection which satisfies permit <br />requirements and Landlord. Gravel mining permit to remain with the parcel <br />involved. Bond posted by Lessee with the Landlord will not be released until the <br />requirements of this section have been satisfied. <br />
