Please refer <br />to the SL-02 findings document for additional detail. <br /> <br />As described below in greater detail under the Alternative Land Uses section, The <br />Unit Train Loadout (UTL) has been backfilled and graded and entirely reclaimed. <br />The Unit Train Loadout was converted to industrial use with approval of PR -4. The <br />rail loop and a portion of the rail spur were left in place as a key feature for the future <br />industrial use of the area. The final contours for the UTL are shown on Exhibit 11C <br />of the PAP. Cross sections representing the existing and final grades are shown on <br />Exhibit 59. Grading of the site involved eliminating the sewage treatment ponds, <br />eliminating most of the embankment that supported the linear stacker and coal <br />stockpile and backfilling the sediment ponds. During the process of grading, light <br />use roads 3 and 5 and portions of light use road 4 and haul road 3 would be eliminated. <br />Following approval of PR-4 (February, 2009) SCC finalized a purchase and sales <br />agreement and sold the loadout property to Halliburton. SCC was given full release <br />of bond liability for the train loadout and overland conveyor areas with approval of <br />SL-07 in 2011. TR-62 was approved in November 2011 allowing SCC to modify the <br />permit area by removing these locations from within the permit boundary. <br /> <br /> In the case of underground mining operations, the applicant has demonstrated that the <br />fill used to eliminate the highwall and depressions meets all the requirements of 4.05, <br />4.06, 4.09 and 4.15. Therefore, the Division proposes to approve that excess material <br />not required for highwall and other depression backfill need not be returned to <br />approximate original contour (4.14.1(2)(e)). <br /> <br />A highwall is the face of exposed overburden and coal for entry into an underground <br />mine. The south portal had two potential highwalls. One was an old ventilation entry <br />along the old portal access road and the other was the intake and beltline entries which <br />were located on the portal bench. The highwalls were eliminated by backfilling the <br />area where the coal seam was exposed. Other near vertical rock faces were excavated <br />to provide room for the warehouse shop and offices. These near vertical rock faces <br />are not considered highwalls so they will not be eliminated. <br />
