BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE REQUEST OF WILLIAMS FORK MINING <br />COMPANY FOR A SECOND FIVE-YEAR PERIOD OF TEMPORARY <br />CESSATION, File No. M-1984-168 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />December 13, 2017 in Denver for a hearing to consider the request for a second <br />period of temporary cessation filed by Williams Fork Mining Company ("Operator"), <br />file number M-1984-168 ("permit"). Russ Means appeared on behalf of the Division <br />of Reclamation, Mining and Safety ("Division"). Forrest Luke appeared on behalf of <br />Operator. <br />The Board, having considered the presentations, testimony, and evidence of <br />the Division' and Operator, and being otherwise fully informed of the facts in the <br />matter, enters the following: <br />FINDINGS OF FACT <br />1. Operator holds a 112(c) reclamation permit for 83.3 acres of sand and <br />gravel mining. The site is known as the Williams Fork Pit. The site is a designated <br />sand and gravel operation and is located in Moffat County, Township 6N, Range <br />91W, Section 16. <br />2. On January 1, 2013, the Division accepted Operator's notice for the <br />first period of Temporary Cessation ("TC -1") for the site, with an effective date of <br />October 26, 2012. <br />3. On October 2, 2017, the Division sent written notice to Operator that <br />TC -1 would expire on October 26, 2017. <br />4. On October 25, 2017, the Division received a request for a second <br />period of Temporary Cessation ("TC -2") for the site. <br />5. On October 27, 2017, the Division sent Operator a notice of <br />incompleteness indicating that the required temporary cessation fee needed to be <br />remitted before the notice for the TC -2 would be considered complete. <br />I The Division was advisory staff to the Board, not a party, in this proceeding. <br />
