2.05.3 <br />(ii)(D) As part of TR -16 a new sediment pond will be constructed south of the mine <br />office and the existing sediment pond will be reclaimed and the coal mine <br />waste pile will be situated in the existing pond footprint. Sediment removed <br />from the existing pond will be placed in the new coal mine waste pile. The <br />old pond will be reclaimed once the proposed sedimentation control plan is <br />configured on site, and water is draining into the new sediment pond. <br />The sediment pond will be removed after the site has been reclaimed and <br />the vegetation on the reclaimed site is adequate to control erosion. Pond <br />removal must be authorized by the Division and the untreated drainage from <br />the disturbed area ceases to contribute additional suspended solids above <br />natural conditions. <br />(iii) The sediment pond does not meet the size requirements of this section, <br />therefore this section is not applicable. <br />(iv) Not applicable, the sediment ponds do not meet the size criteria. <br />(v) Not applicable, plans do not need to be submitted to MSHA or the Office of <br />the State Engineer. <br />(vi) The impoundment does not meet the class B or C criteria for dams. The <br />pond is considered a class A dam. Class A dams are dams located in rural <br />or agricultural areas where failure may damage farm buildings, agricultural <br />land, or township and country roads. <br />(vii) The impoundment does not meet the class B or C criteria for dams. <br />(b) The sediment pond is considered a temporary pond and is designed to meet <br />the requirements of Rules 4.05.6 and 4.05.9. <br />Pond Inspection, per Rules 4.05.9(14), (15) and (17). All impoundments <br />shall be inspected by a qualified registered professional engineer or other <br />qualified professional specialist under the direction of a professional <br />engineer. The professional engineer or specialist shall be experienced in <br />the construction of impoundments. <br />PR -02 2.05-21- 10/12 <br />
