The <br /> Ownership and Encumbrance Report is in reference to Item No.5 on the Request for Transfer of Mineral <br /> Permit. This plat map was not recorded with a reception number but deposited in the County Clerk and <br /> Recorder's Office of Rio Blanco County and Rio Blanco County Abstract Company receives copies of all <br /> plats that are recorded and deposited. <br /> I am in error in that I thought we were going to relinquish the gravel permit,we are having it transferred <br /> back to us from XTO at this time and eventually the land will be returned to an agricultural status. The <br /> actual land used for this permit was about 3 acres and not the full 9 acres as disclosed on the attached <br /> plat map. <br /> With regard to Item No.6 on the Request for Transfer of Mineral Permit,there are no structures or <br /> county roads within 200 feet of the permitted gravel pit. We cannot address structure agreements as <br /> there are no agreements and no structures.
