On September 21,2012 notice was given to extend the term of the lease an additional 5 year <br /> Renewal Period as part of the lease agreement pursuant to the terms of the original lease dated September 30, <br /> 2002.As indicated in the letter the term will extend to December 31,2017.Please see the attached document for <br /> reference. <br /> The State of Colorado,Division of Reclamation,Mining and Safety("DRMS")requires that in order to make this <br /> name change public that we file a Succession of Operators Application and seek your acknowledgement. <br /> Kilgore Companies dba Peak Materials will be the operator and will be responsible to continue to conduct all <br /> mining operations and ancillary activities on the Leased Premises. <br /> Please acknowledge your understanding of these facts by countersigning below and forwarding one copy of the <br /> original signed page to me at the address listed above or via email.
