Delta County Administrator <br />January 19, 2018 <br />TO: Colorado Division of Reclamation Mining and Safety <br />RE: Bowie No 1 Mine Permit Revision <br />Delta County understands that Bowie Resources has submitted a permit revision to change the Division of <br />Reclamation Mining and Safety approved post mining land use at the Bowie No. 1 Loadout from <br />cropland/rangeland to industrial. <br />Delta County's land use plan is not based on traditional land use zoning and thus doesn't use normally <br />accepted industry terms such as residential, agriculture, commercial, or industrial. Instead, Delta County <br />uses a land use process based on change of use called Specific Development Regulations that sets forth a <br />public review process and performance standards for the administration of specific development activities <br />within the unincorporated area of Delta County and providing for the requirements and issuance of a <br />Development Agreement for specific developments. <br />Delta County Specific Development Regulations were adopted on November 1, 2000 and amended several <br />times since. On November 1, 2000, the Bowie No. 1 was being used as a coal mine related facility. <br />Per the Delta County Specific Development Regulations Article I, Section 5, Paragraph A., "all <br />developments or land use activities that are in place as of the date of the adoption of this regulation may <br />continue by right without need for review or a Development Agreement." <br />If you have any questions, feel free to contact me at rlevalley@deltacounty.com. <br />Sincerely, <br />Robbie Baird LeValley <br />Delta County Administrator <br />
