Since the last Midterm Review, MT -04 in January 2016, one technical revision (TR -19) and one <br />minor revision (MR -15) have been approved. Another minor revision application (MR -14) was <br />submitted, but this was withdrawn by NECC. No permit revisions or bond release applications <br />were submitted during that time. <br />TR -19 revised a PAP exhibit (Exhibit 15) to show an altered schedule for pond cleaning. Exhibit <br />15 also includes SEDCAD analyses to support this change. This revision did not propose any on - <br />the -ground changes at the mine site, nor does it change the Reclamation Cost Estimate for the <br />Lorencito Canyon Mine permit. It was issued on October 4, 2016. <br />MR -15 updated Sections 2.03 (ownership and compliance information) and 2.05 (surface water <br />control information) of the PAP in response to the midterm (MT -04), but did not propose any on - <br />the -ground changes at the mine site or change the Reclamation Cost Estimate. It was issued on <br />February 23, 2017. <br />Summary <br />The Review Process <br />In accordance with Rule 2.08.5(2)(a), the Division notified NECC on March 28, 2017 that a <br />complete application for a permit renewal must be received by the Division by May 11, 2017 <br />(180 days prior to permit expiration) as required by Rule 2.08.5(3)(f). On May 9, 2017 the <br />Division received (via email) an application for permit renewal (RN -04) from NECC. (The hard <br />copy was received on May 11, 2017.) <br />On May 10, 2017, the Division found the application complete. Notification of the filing of a <br />complete application for permit renewal was sent to the appropriate governmental agencies, <br />including the Las Animas County Planning Office, Las Animas County Commissioners, the <br />Office of Archaeology and Historic Preservation (State of Colorado), US Fish and Wildlife <br />Service, and Colorado Parks and Wildlife. <br />Public notice announcing the filing of a complete renewal application was published in the local <br />newspaper, The Chronicle -News, on June 5, June 12, June 19, and June 26, 2017. The Division <br />received proof of publication on August 2, 2017. <br />The Division queried the Applicant Violator System (AVS) on August 7, 2017 for permittee <br />New Elk Coal Company. The query returned no records of violation. <br />In a letter dated May 25, 2017, the State Historic Preservation Office (Archaeology and Historic <br />Preservation) stated their opinion "that a finding of no historic properties affected is appropriate" <br />for the renewal. No other comments were received by other agencies. <br />The Division conducted a preliminary adequacy review of the renewal application. This was sent <br />to NECC on August 7, 2017. An update of the reclamation cost estimate was sent on September <br />7, 2017. <br />11 <br />
