Introduction <br />This written findings document was prepared by the Colorado Division of Reclamation, Mining, <br />and Safety (the Division) for the Lorencito Canyon Mine. This document includes: <br />1) the proposed decision on the permit renewal (RN -04) application; <br />2) the status of stipulations and revisions; <br />3) a summary, which includes a history of the review of the permit renewal application, a <br />description of the environment affected by the operation and a description of the mining <br />and reclamation plan; and <br />4) the written findings of compliance the Division has made as required by the Colorado <br />Surface Coal Mining Reclamation Act. Detailed information concerning the findings of <br />compliance can be found in the Regulations of the Colorado Mined Land Reclamation <br />Board for Coal Mining. <br />The Division received an application for a permit renewal (RN -04) to continue surface coal <br />mining and/or reclamation operations at the Lorencito Canyon Mine. The application was <br />submitted by New Elk Coal Company, LLC (NECC). The mine is located on private lands <br />within Las Animas County, Colorado. A detailed legal description of the lands included within <br />the permit area is described using the metes and bounds method in Exhibit 2 of the permit <br />application package (PAP). The lands within the permit area are part of the original Maxwell <br />Land Grant which was not surveyed within the scope of the U.S. survey system of public lands. <br />It can generally be described as lands south of the Purgatoire River, southeast of Cow Canyon, <br />northwest of Jeff Canyon, and west of Lorencito Canyon (the eastern boundary is approximately <br />one mile west of the channel of Lorencito Canyon). The permit area, shown on map below, <br />covers approximately 384 acres. (This area was reduced from 3,142 acres with TR -18 in 2014.) <br />
