UNITED STATES <br />DEPARTMENT OF THE INTERIOR Serial No.: COC 1362 <br />BUREAU OF LAND MANAGEMENT Date of Lease: September 1 I967 <br />MODIFIED COAL LEASE <br />PART I. <br />THIS MODIFIED COAL LEASE is entered into on DEC O 12017 by and between the UNITED STATES OF AMERICA, <br />hereinafter called the Lessor, through the Bureau of Land Management, and <br />Mountain Coal Company, LLC <br />One CityPlace Drive, Ste. 300 <br />St. Louis, MO 63141 <br />hereinafter called Lessee. <br />This modified lease shall retain the effective date September 1, 1967, of the original Coal Lease COC 1362, and is effective for a <br />period of 20 years therefrom, and for so long thereafter as coal is produced in commercial quantities from the leased lands, subject to <br />readjustment of lease terms at the end of the 20th lease year (September 1, 1987), and each 10 -year period thereafter. <br />Sec. 1. This lease is issued pursuant and subject to the terms and provisions of the Mineral Lands Leasing Act of 1920, as amended, <br />41 Stat. 437, 30 U.S.C. 181-287, hereinafter referred to as the Act; and to the regulations and formal orders of the Secretary of the Interior <br />which are now or hereafter in force, when not inconsistent with the express and specific provisions herein. <br />Sec. 2. Lessee as the holder of Coal Lease COC 1362, issued effective September I, 1967, was granted the exclusive right and <br />privilege to drill for, mine, extract, remove or otherwise process and dispose of the coal deposits in, upon, or under the lands described <br />below as Ori ginat Lease and ModiOcation 1. <br />The Lessor in consideration of fair market value, rents and royalties to be paid, and the conditions and covenants to he observed as <br />herein set forth, hereby grants and leases to Lessee the exclusive right and privilege to drill for, mine, extract, remove, or otherwise <br />process and dispose of the coal deposits in, upon, or under the lands described below as Modification 2: <br />Origin d I -ease: Sixth Principal Meridian, Colorado <br />T. 13 S., R. 90 W., <br />secs. 27 and 28; ' <br />sec. 29, lots I thru 14; <br />sec. 30, lots 5, 6, and 9; <br />sec. 32, lots 1 thru 9, excluding 24.8 acres in Independent Reservoir; <br />secs. 33 and 34. <br />T. 14 S., R. 90 W., 6th P.M. <br />sec. 3; - <br />sec. 4, lots 1 thru 3, S'/zNE'/4, SE'/4NW'/a, 06SW'/a, and SE'/; <br />sec. 9, N'/zNE'/4, and SEIANE'/4; <br />sec. 10, N'h. <br />Containing 4,836.36 acres in Gunnison County, Colorado. <br />Modification.. 1; Sixth Principal Meridian, Colorado <br />T. 13 S., R. 90 W., <br />sec. 35, lots 3, 4, 19, 27, 29, 31, and 34. <br />Containing 160.92 acres in Gunnison County, Colorado. <br />Modification 2; Sixth Principal Meridian, Colorado <br />T. 14 S., R. 90 W., <br />sec. 10, NE'/4SW'/4, and SE'/4; <br />sec. 11. S'hNW'/4, and SW'/4; <br />sec. 14, NE'/4NW'/4, NWIANW'/4, SW'/4NW'/4, W'ME'/NW'A, WME'/4SWIA, and NW1/4SWIA; <br />sec. 15, E'/zNE'/4, and N'ME'/4. <br />Containing approximately 800 acres, more or less, in Gunnison County, Colorado. <br />containing 5,797.280 acres, more or less, together with the right to construct such works, buildings, plants, structures, equipment and <br />appliances and the right to use such on -lease rights-of-way which may be necessary and convenient in the exercise of the rights and <br />privileges granted, subject to the conditions herein provided. <br />
