Section 2.05.3(3) and associated attachments of the permit address <br />descriptions, designs and plans for surface water structures adequately meeting the <br />requirements of rule 2.05.3. Recent completed permitting actions include Pond as <br />built designs and culvert additions while an in process action encompasses an <br />alternate sediment control demonstration (TR83). <br /> Adequacy <br />2. Until TR’s 83 and 77 are finalized this item remains open. <br />Rule: 2.05.4(2)(h) Reclamation Plans <br />The general requirements of this portion of the Reclamation Rule include: <br />A description of steps taken to comply with the Clean Air (42 U.S.C. Sec. 7401 et <br />seq.), and Clean Water (33 U.S.C. Sec. 1251 et seq.) acts and other applicable air <br />and water quality laws and regulations. <br />This item is adequately addressed in the permit. <br />Rule: 2.05.6(1) Mitigation of Impacts <br />Construction/Emissions permits approved in 2006 by CDPHE Air Pollution Control <br />Division are provided in Section 2.04.8-1 of the permit and adequately address <br />the requirements of this rule.
