Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to APPROVE an application <br />for permit revision PR8. <br />The application was submitted by Trapper Mining, Inc. This decision is based on a finding that the <br />operations comply with all requirements of the Colorado State Program as found in the Colorado <br />Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated <br />pursuant to the Act. If no request for a formal hearing is made within thirty (30) days of the first <br />publication of the issuance of this proposed decision, then this decision becomes final. The permit <br />will be renewed upon submittal to DRMS of acceptable surety by the applicant. The permit <br />application, all supporting documentation and any stipulations or conditions become a binding part of <br />the permit. <br />No coal mining operations may be conducted on any Federal surface or coal until the Assistant <br />Secretary for Lands and Minerals Management with the U.S. Department of the Interior has <br />approved any required federal mining plan or modification thereof. <br />This proposed decision encompasses the addition of five proposed ponds adding 25 acres to the <br />current disturbed acres of 2988.8for a total disturbed acreage of 3,013.8. <br />As a result of the Permit Revision 7 (PR7) review process, Trapper agreed to remove from the <br />approved permit the 31.79 -acre 2017 topsoil stripping area approved under Permit Renewal 6 <br />(RN6), reducing the area approved for topsoil stripping within the existing permit area under <br />RN6, Technical Revision 113 (TR113) and Minor Revision 220 (MR220) from 96.40 acres to <br />64.61. During additional review of PR7, Trapper agreed to revise the number of acres <br />previously approved in RN6 for topsoil stripping in calendar year: <br />0 2015 from 24.79 acres to 25.00 acres, <br />0 2016 from 32.92 acres to 33.10 acres. <br />This brought the total number of acres approved for topsoil stripping within the existing permit <br />area approved under RN6 and modified by TRI 13, MR220, and PR7 to 65.0 acres (4.60 + 2.30 <br />+ 25.0 + 33. 1, as shown in Table 3.1-3 of the permit), as requested in the PR7 application. This <br />table shows the approximate yearly disturbance and reclamation by phases. Portions of haulroads, <br />topsoil stripping areas and mining areas projected for the PR7 permit term fell outside the <br />approved drainage and sediment control plan boundaries at that time (2015). This issue was <br />identified during the review of RN6. Given this, the Division approved the RN6 permit <br />renewal application with the following stipulation: <br />Stipulation No. 21: <br />The operator must submit and receive approval for a permit or technical revision to <br />update the drainage and sediment control plan prior to any disturbance outside of the <br />currently approved drainage and sediment control boundary. <br />As of November 2017, this stipulation has been met as follows: <br />Trapper submitted pond designs for Deal, Deacon and Jeffway ponds with its PR8 application. <br />
