Summary <br />The Review Process <br />Seneca Property, LLC, a subsidiary of Peabody Investments Corporation, submitted a permit <br />renewal application (RN -04) for the Yoast Mine. The Yoast Mine was exclusively a surface coal <br />mining operation located approximately 22 miles southwest of Steamboat Springs, Colorado in <br />Routt County. Permit No. C-1994-082 was issued on August 5, 1995, and has been renewed <br />every five years since that date. <br />For the current renewal RN -04, the Division notified Seneca Property, LLC by letter on <br />December 10, 2014 that its permit for the Yoast Mine would expire on August 5, 2015. The <br />letter explained that, for operations to continue beyond that date, Section 2.08.5(3)(f) requires an <br />application for renewal to be received on or before February 8, 2015. Seneca Property, LLC <br />submitted a renewal application on January 27, 2015 and the application was found complete on <br />January 30, 2015. TC published a notice of the application in the Steamboat Pilot, four <br />consecutive weeks from December 2, 2012 through December 23, 2012. <br />No objections regarding the application were received. <br />The Office of Surface Mining's applicant violator system (AVS) was queried on January 30, <br />2015 and the recommendation of the system was to provide ownership and control updates. A <br />follow-up AVS query was conducted on October 25, 2017 and resulted in a recommendation to <br />issue this RN -4 renewal. <br />On September 30, 2015, the Division sent an adequacy letter to SP requesting additional <br />information with regards to portions of the permit. SP provided responses to the Division's <br />adequacy letter in a letter dated October 17, 2017 and received by the Division on October 19, <br />2017. The Division updated the Reclamation Cost Estimate on March 6, 2017. All adequacy <br />concerns have been resolved; therefore, the Division proposes to approve the renewal <br />application. <br />Publication of this proposed decision initiates a thirty -day public comment period. Provided there <br />are no objections to the decision, the proposed decision will become final at the close of the <br />comment period. <br />
