particular incident that occurred sometime in 1994, when a blanket of corrosive
dust descended the area of LaPorte. According to those who witnessed the incident
the dust particles bore holes through leaves and ended up killing vegetation in the
area.
It is my understanding that legal counsel was sought. However, I am not sure of the
disposition of the case.
The people of LaPorte have reason to believe a reasonable likelihood of a
recurrence of another Donora incident in consideration of:
1. The 1994 Glass Factory particulate shower incident
2. The topography of the LaPorte region, which renders it conducive to SMOG and
the natural meteorological phenomenon of temperature inversion
3. The excessive discharge of particulate pollutants in the air by high-density
mining and other existing heavy industry in the area which includes a heavy
industrial Lime Hydrator.
4. Proliferation of open-pit mining and the accompanying trail dust
5. The proximity of heavy industry to homes in the area
In lieu of an existing disparity of a Health Risk Assessment Study that had been
granted to Oil and Gas communities but adversely denied to aggregate mining and
processing-when in fact the same cumulative non-occupational risks to health and
safety are common to both communities; it appears that the community of LaPorte
has been denied the rizht to equal protection of the Law.
I am earnestly appealing to the CODRMS, for help in investigating the excessive
mining in the area of LaPorte as it relates to a serious threat to Public health and
safety and the possible violation of Atmospheric Trust.
The hopeful folks of historic LaPorte are respectfully calling upon the CODRMS
for help in the fulfillment of the special protection of the Cache La Poudre River
and nearby LaPorte, as mandated by the Clean Air Act and the regulations of the
Prevention of Significant Deterioration(PSD).
Thank you Mr. Ebert, for your time and attention.
Sid( rely,
12112512017
i
3
