COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Decmeber 29, 2017 <br />Interofce Memo <br />King Coal Mne (Permit No. C-1981-035) <br />2017 Fourth Quarter Waste Pile/Embankment Inspection Reports Review <br />M. <br />I have reviewed the 2017 Fourth Quarter Waste Pile/Embankment Inspection Reports (Reports) <br />for the King Coal Mine and have found them in compliance with the following Rules: <br />• 4.09. l (11)(a) — The coal mine waste bank was inspected by a qualified professional <br />engineer during the fourth quarter. Ryan Griglak, P.E., of Stoner Engineering & <br />Surveying, inspected the waste pile on behalf of GCC Energy, LLC. The inspections <br />occurred during the fourth quarter of 2017. <br />• 4.09. l(11)(b) — The inspection occurred on December 19, 2017 and the reportwas dated <br />December 22, 2017. There is no visible recieved time stamp with the report but since the <br />time of my review request was within two weeks of the inspection, it can be assumed it <br />was received by the Division within the required time. <br />• 4.09. l(11)(c) — This rule is not applicable during this phase of waste pile construction <br />unless being constructed in stages. <br />• 4.10.2(1) — Refer to Rule 4.09.1(11) (a) of this memo. <br />• 4.10.2(2)(a) — Refer to Rule 4.09. 1 (1 1)(b) of this memo. The Division does not require <br />additional inspection frequency for the King Coal Mine waste pile. <br />• 4.10.2(2)(b) — King Coal Mine is required to submit compaction results to the Division at <br />least once every two years. Compaction results were not submitted with this inspection <br />report. The last compaction reportreceived by the Division was in 2017, thus no <br />compaction results are necessary at this time. <br />• 4.10.2(2)(c) — Visible evaluation of the waste pile was documented in the Report. No <br />signs of instability or potential hazards to life and property were noted in the Report. <br />• 4.10.2(2)(d) — Copies of the inspection findings shall be maintained at the mine site. <br />As you mentioned in your previous review in the 2017 third quarter review, additional discussion <br />regarding the underdrain would be helpful in the Division's review. However, with the <br />underdrain construction completed and fully buried with refuse, discussion regarding the <br />underdrain is limited to observed water expression through the outlet. That being said, in the <br />Report, Mr. Ryan Griglak notes water/ice build up along the outlet of the underdrain due to lack <br />of grade in that area which has the potential to back up subsurface water within the pile.
